Shehasbeenemployedatthefacilitysinceonor aboutFebruary13,2017,andhasheldaTopSecretclearanceduringthattime. Assetforthin furtherdetailbelow,onoraboutMay9,2017,WINNER printedandimproperlyremoved classified intelligence reporting, which contained classified national defense information and was dated on or about May 5, 2017 (the “intelligence reporting”) from an Intelligence Community Agency (the “U.S. Government Agency”) and unlawfully retained it. Approximately a few days later, WINNER then unlawfully transmitted the intelligence reportingtoan onlinenews outlet(the”News Outlet”).
12. OnJuneI,2017,theFBIwasnotifiedbytheU.S.GovernmentAgencythatthe U.S.GovernmentAgency had beencontactedbytheNews Outleton May 30,2017,regardingan upcomingstory. TheNewsOutletinformedtheU.S.GovernmentAgencythatitwasin possession of what it believed to be a classified document authored by the U.S. Government Agency. TheNewsOutletprovidedtheU.S.GovernmentAgencywithacopyofthisdocument. Subsequent analysis by the U.S. Government Agency confirmed thatthe document in the News Outlet’spossessionistheintelligencereporting. Theintelligencereportingisclassifiedatthe Top Secret level, indicating that its unauthorized disclosure could reasonably result in exceptionallygravedamagetothenationalsecurity,andismarkedassuch. The U.S. Government Agency determinedthatsixindividualsprintedthisreporting. WINNER wasoneofthesesixindividuals.
